*MAI ƘWACE KYAUTARSA*

As-Salaam Alaikum Wa Rahmatul Laah,

Menene hukuncin wanda zai yi kyautan abu, daga baya kuma sai ya ƙwace shi?

AMSA A134:

Wa Alaikumus Salaam Wa Rahmatul Laah Wa Barakaatuh.

A ƙa’idar musulunci kyauta iri-iri ce: Akwai kyautar da ake iya komowa a karɓe ta, akwai kuma wacce ba a iya karɓe ta.

[1] Da farko ma dai kyauta ba ta tabbata sai a lokacin da ta kai ga wanda aka yi masa kyautar. Don haka, malamai suka ce: Ya halatta, a sahihiyar magana, musulmi ya yi kyauta amma kuma ya fasa tun kafin kyautar ta kai hannun wanda aka yi wa. Amma idan kyautar ta kai gare shi, kuma ya karɓe ta, to a nan haram ne ya ce ya fasa, ko kuma ya karɓe kyautarsa, ko da kuwa wanda aka yi wa kyautar ya amince da haka. Saboda hadisin Annabi (Sallal Laahu Alaihi Wa Alihi Wa Sallam) da Al-Bukhaariy (2589; 6975) da Muslim (1622) da sauran malamai suka riwaito cewa:
Mai komowa a kan kyautarsa kamar kare ne: Ya yi amai, sannan ya koma ya cinye shi!

[2] Idan mahaifi ne ya yi kyauta ga ɗansa, malamai sun amince cewa yana iya komowa ya karɓe shi saboda hadisi sahihi da Abu-Daawud (3539) da At-Tirmiziy (2132) da An-Nasaa’iy (6/265) da Ibn Maajah (2377) suka riwaito kuma Al-Albaaniy ya inganta shi a cikin Sahih Al-Jaami’: (7655) cewa:
Ba ya halatta ga mutum ya yi kyauta sannan ya koma ya karɓe shi, sai dai in mahaifi ne a cikin abin da ya bayar ga ɗansa.

[3] Haka kuma idan mutum ya yi kyauta don neman lada ko sakayya a wurin Allaah da hakan, ko kamar don sada-zumunci, a nan ma bai halatta ya komo ya karɓe kyautar daga baya ba. Amma idan tun asali kyautar ta neman sakayya ce kamar kyautar manemin aure ko wani abu, a nan yana iya komowa ya karɓi kyautarsa idan bai samu buƙatarsa ba. Al-Imaam Maalik a cikin Muwattaa da Al-Baihaqiy a cikin Sunan Al-Kubraa sun riwaito atharin da Al-Albaaniy ya inganta shi a cikin Al-Irwaa’u: 1613 daga Babban Khalifa kuma Amirul Mu’mineen Umar Bn Al-Khattaab (Radiyal Laahu Anhu) ya ce:
Duk wanda ya bayar da kyauta don sada-zumunci ko ta fuskar sadaka, to shi ba zai iya komowa ya karɓe ta ba. Amma wanda ya bayar da kyauta, yana nufin samun sakayya, to shi yana nan a kan kyautarsa, kuma yana iya komowa idan bai yarda da ita (sakayyar) ba.

Malamai sun ambaci wasu fuskokin da ba a iya komowa a karɓe kyauta a cikin littaffan fiqhu, kamar Tamaamul Minnah: 4/128-9.

Allaah ya datar da mu gaba-ɗaya ga abin da yake so, kuma yake yarda da shi.
