The following morning Andrew was found dead in a parking lot at Keystone State Park. He had been shot five times in the face, chest and buttocks. His colleague told the police about his meeting with Shirley and they contacted her for questioning. She claimed she was in bed sick on that day, however cell phone and internet records show she made cross country calls both to and from the town Andrew resided. She had accessed eBay and hotmail from Andrew's computer and used his home phone to call in sick to her job.

When confronted with this, she said she has made Andrew at Keystone State Park but he'd taken her fun and put it in his trunk. Shirley alternatively told her shooting instructor the gun had been stolen. She couldn't keep her story straight. A hiker travelling through the park reported seeing Shirley's car next to Andrew's. Mapquest printouts for road directions for the town Andrew lived in were also found in Shirley's apartment.

Despite the evidence, Shirley had fled the country to Canada by the time authorities obtained a warrant to her arrest. But to her horror, upon arrival, she discovered she was in fact pregnant with Andrew's child.

On the 12th of December Shirley was finally arrested, however, the judge believed that Shirley was not a threat to society, despite the pending murder charges and granted her bail. She was required to post $75,000 bail, turn in her passport, promise not to leave the area and make no attempt to contact Andrew's family. The news that Shirley was pregnant broke and thus a battle for custody began.

Andrew's parents, David and Kathleen, moved to the same town Shirley was living in, St. Jones, Newfoundland in order to fight for custody of their son's child. The Baby was born on the 18th of July, 2002, his name was Zachary. Shirley continuously refused to allow David and Kathleen see their grandson, fearing they would kidnap him, she even fired her family lawyer because of his positive attitude towards Andrew's parents. On several occassions it was noted that Zachary was unusually detached from his mother and preferred the company of others, especially Andrew's parents.

Once a provincial court ruled there was enough evidence that pointed to Shirley being Andrew's killer she was put in jail until she would be extradited to the US for the murder trial. Because of this Kathleen and David were awarded custody of Zachary.
