Yes, psychopaths have very similar traits of those of sociopaths, however still differing in multiple cases.

Sociopathy, as we've established, have the case of ASPD (Anti Social Personality Disorder) which leads them to become sociopaths because of the ASPD symptoms. Psychopaths on the other hand, have sociopathic symptoms all together, and more. This gives us a perspective. All psychopaths are sociopaths, but not all sociopaths are necessarily psychopaths. Psychopaths are born with the disorder, sociopaths are developed into it.

Psychopaths have a higher tendency in the criminal justice system.

Sociopaths LACK empathy. That does not mean that they are completely out of it. Psychopaths just don't have empathy, which makes them more troublesome and dangerous to the people around them.
