The U.S. Supreme Court has ruled that police departments must obtain a warrant to search a vehicle if the defendant is in physical custody and cuffed in the back of a police cruiser. In a far reaching decision, the Court, led by Justice Stevens, said that unless there is the risk of the Defendant reaching for a weapon in the vehicle or that evidence of a crime actually exists in the vehicle, a search warrant is needed to search through the car. This is a big departure and clears up some real confusion in this body of law. Some will claim that it places too much of a burden on police departments, but I believe it will actually clarify how they handle these very common situations.
