Custody fucking papers
He handed me custody papers over my kids.
What case does he have against me? He came back from the dead, used a fake identity, and is a mafia leader. There's no way in hell I'll let this happen.
I picked up my phone and called that unknown number
"Hello" he said
"Custody papers, seriously?" I questioned with anger laced in my tone
"You won't let me see my kids, so this is what I have to do now" he replied
Stand your grand stassie
"What case do you have even against me, you're the one who's dead" I said
"Not anymore, you should be getting an article soon in about 5.4.3.2.1 and it's out" he said
I looked on my computer to see multiple articles saying Stefan is alive.
His team says he was in witness protection. What the fuck
"What game are you trying to play Stefan. Destroy one family then another" I asked
"No, I just want my family back" he replied
"You lost them the day you died." I said
"And you won't let me explain what happened" he shouted
"Go ahead, show me why you left" I said
"You'll be getting an email, it's an attachment of the stuff I got that made me fake my death" he said
"I'll be waiting for the stupid excuse" I said
I wait for the email and once I get it I go through it. It's pictures of the kids walking into school, at school, me walking with them and more of those. There were letters saying that one of us will die everyday and it's all because of Stefan. The person wanted something from Stefan
"This is the reason why you left?" I questioned
"There's more to it but yeah this is why. The amount of death threats and pictures I'm getting of the family. When I died, you stopped receiving them and no one would harm you knowing you mean nothing to the mafia now since I'm dead" he said
I started laughing, that's the reaction I have.
"Naive naive Stefan. That was nothing compared to what I got. You left because you thought it was better for us, a coward running away from the problem." I said with a chuckle. God he's so dumb. "See that's the difference between us, I fight my problems, you run. After you left, I took over and let's just say I got daily threats and some were from my own mafia but the thing is I didn't run. I took care of it, making sure the person is dead and not in an easy way" I said
"I had to protect you guys" he exclaimed through the phone
"No you wanted the easy way out. I remember the week before you told me that we should leave forever, the mafia and everything and go to an island. Have a new life but you decided to do that on your own" I said
"I was throwing shit out there, it meant nothing" he said
"You're a fucking liar. You make up bullshit and continue to think that." I replied
"Believe what you want but I promise you I will come for my kids" he said
"Go ahead, you won't win" I replied
"Try me" he said. I hung up the phone looking back at the papers.
I called Matthew for him to come over which he gladly agreed to.
"Guess what that son of a bitch gave me" I said to matthew
"What?" He questioned
"Custody papers" I replied
"What case does he have against you?" He questioned
"I don't know, but now I need to get my lawyers. If he wants to play this game, he better be prepared" I said
"I'll call them right now" he replied. He called our lawyers and we met them at my office in the city. We started building our case, saying he faked his death, used someone else identity, etc.
We were gonna fight hard
When I got home I told the kids to sit down in the family room. I couldn't let them go to court and find out their father is alive.
"I want to tell you now before someone else does." I said sighing knowing utter chaos will come out from this
"Your father is alive" I said
Madeline and Anthony started yelling and was confused
"But that isn't the only thing" I said
"Your father is trying to get custody of you guys" I said
Not the twins are yelling as well.
"I don't want to see dad" Ella shouted
"Listen, I will be trying my best to make sure that doesn't happen. I am building my case and I will not let him take you guys but I want you guys to be prepared" i said
"He can't take me, I don't want to go" Madeline screamed
"I won't let that happen, don't worry." I said
"Good" she huffed
I talked to them that it won't happen and then they went up to their rooms.
1 month later
Today is the trial and I was nervous. Jenna was called on the stand, so is matthew and the court is making Elijah and Ella talk today. I know this isn't gonna be good for them because Stefan's lawyer is gonna go hard on them.
"Ok, today is gonna be hard and if it's too much tell me." I said
"Ok" Elijah replied
We walked into court and I sat with my lawyer and across from me was Stefan and his lawyer. The kids stayed outside until they are called in.
"We are here for the custody battle of Stefan Aveline and Anastasia rose" the judge said
We went through the beginning and they first called Jenna up to the stand
"Jenna, how long have you know Anastasia?" Stefan lawyer asked
"Pretty much since I was a baby" she replied
"So you've been there when she first started drugs, and how old was that?" He asked
"Objection" my lawyer yelled
"Overruled" the judge replied
"She was 16" Jenna said
"Wow, so a very young age" the lawyer replied
"Does Anastasia every show her addiction tendency whether it be through work or home. Or when she relapsed 1 year after giving birth to her son Anthony" he stated, staring to attack Jenna
"Objection, he is attacking the witness" my lawyer shouted
"Overruled" the judge replied
"She doesn't, she's strong and that addiction wasn't her fault" Jenna shouted
"It's her fault, she continued with it and never got help" he said
"Never got help? Are you joking-
"That is all Jenna" he said. Stefan's lawyer backdown and now it was our turn
"Jenna, when you say it isn't her fault for the one time. Could you elaborate" my lawyer asked
"Yes, I found my best friend drugged and as an addict it can be hard to stop but she pushed through it and stopped. She got cleaned and has been since that year" Jenna said
"Those other times, do you mind telling us what happened" the lawyer asked
"Yes, the very first time we were all stupid kids. We didn't know at that time how strong and deadly it can be. She got addicted and started using them to cope with her parents kicking her out and benched on the team. But we helped her get clean. The other time was when she overdosed due to traumatic stress and being emotionally abused in her home but she insisted on getting clean which she did. And let me clarify, all of these incidents weren't for fun, she was trying to cope in order to get rid of pain but now she continues to cope with it better as she has grown." Jenna said trying to give the best outcome
"The other time she was still young, she lost her baby which affected her greatly. Not only she lost her parents but she lost her baby. Continuing on down the line she wasn't able to have her own kids so she had surrogates which I myself was one. Then her last kid, Anthony which she almost died in childbirth but she was strong and pushed through it. Anastasia is a strong women and those mistakes she has learned from. She is the strongest women I know" Jenna said. I gave her a smile knowing she did amazing.
"That is all Jenna, thank you" he said. Next up was matthew and hr had known both of us but he's on my side. He knows how to do this, it isn't the first time he's in court.
Once he was done, Dr. Williamson was brought on.
"Dr. Williams, would you say Anastasia is a spontaneous person?" Stefan's lawyer asked
"Yes but she's also learned to control it" she replied
"Spontaneous enough to possibly relapse if something is thrown her way?" He asked
"No, because if she were, we would see her high out of her mind right now" she replied
"But those other times, when she did relapse" he said
"She was still young our brain isn't fully developed by then. Her action back then don't define who she is now" Dr. Williamson said
"Let me ask you Dr. Williamson, how long has Anastasia been in therapy?" He asked
"I've been seeing her for roughly 14-15 years but it always ranged. We would do sessions maybe once a month or if something happened she would see my twice a week in order to get help and understand it better" she replied
"So she's never been okay?" He asked
"She has, going to a psychiatrist-
"That is all Dr. Williamson" his lawyer said. Now it was time for our questioning
"Dr. Williamson, how long has Anastasia kids been in therapy?" My lawyer asked
"Roughly 5 years" she replied
"And have you seen them grow mentally?" He asked
"Yes, they've grown a lot" I replied
"Can you tell us what Madeline's diagnosis?" He asked
"She has panic disorder, agoraphobia, and generalized anxiety disorder. She has medication for it" she replied
"And how has she been?" He asked
"Getting better but its still very prominent but she's working there to get better" she replied
"And why do you think this happens" he asked
"Because she gets scared and starts to panic whenever she's away from her comfort places like home or with her mom. Because of Stefan's passing she is scared that her mom will disappear and won't come back like Stefan" she replied
"So Stefan's disappearance caused all of this?" He asked
"Yes" I replied
"And the twins, how have they been?" He asked
"Good, able to maintain their emotions especially when their father is brought up" she replied
"Ok, that is all dr. Williamson. Thank you" he said
Next is Elijah's turn, Ella was no longer needed. After would be my turn then Stefan's and I testimony
"Elijah, how often do you see your mom?" Stefan's lawyer asked
"Almost everyday" he replied
"And how long do you see her?" He asked
"Probably passing by in the kitchen or us telling her goodnight" Elijah replied
"So she doesn't eat dinner or spend time with you?" He asked
"She does but not everyday. We both have busy schedules" he replied
"do you think she could spend time with you more?" He asked
"Yeah but I know we're both busy with work and school. So it's fine" Elijah replied
"Ok that is all" Stefan's lawyer said. We rebuttal and then it was my turn
"We have some new evidence" Stefan's lawyer said
"This hasn't been approved" my lawyer yelled
"I'll allow it" the judge said
They played the evidence for the room. It was a video of my yelling at Stefan outside my house and the phone call
"This was on private property and no one gave him access" I shouted
"Settle down" the judge said
"Anastasia, you said you want to relapse everyday in the video. Is that true?" He asked
"No, I wante-
"The video says otherwise, so I'll ask again. Do you want to relapse everyday?" He asked
"Yes but not anymore. I was going through something" I said
"How often do you think of relapsing?" He asked
"Object" my lawyer shouted
"Overruled" the judge replied
"I don't know, not often because I've changed" I said
"After Stefan died you decided to go to work, why did you not stay home? You had the money" he said
"Because it was his legacy and I wasn't gonna let it go. It was something I still had of him" I replied
"Yet you let go of your own kids" he replied
"Are you kidding me, I gave my life up for these kids-
"Settle down" the judge said banging his gavel.
"That is all judge" he said
Now it my lawyers turn and he played it where I was the good person and the addiction was in the past.
"Now we will hear the personal testimony" the judge said
"I have been gone for a while, losing all those memories I could have made in order to protect my family. I love them so much and I just want to be able to see them and make more memories again. I love them so much" he said while crying
Bull shit
"My kids have been through a lot, coping with Stefan death and having their whole life changed. It is not easy for them and having their father alive again is causing mixed emotions. My kids deserve some peace in life, I wouldn't do anything to harm them. I love my kids and I just want the best for them" I said
"Ok, I have heard both sides and I have came to the conclusion" he said
"The full custody of Ella, Elijah, Madeline and Anthony Aveline will go to.....
